What is the settlement about?

A class action lawsuit has been filed against Bank of America, alleging that the bank violated the Telephone Consumer Protection Act (TCPA) by sending late-night debt collection messages to customers in Florida.Under the terms of the settlement, Bank of America will contribute $500,000 to a class action fund.Bank of America Florida customers who received collection notices between April 20, 2020 and today are eligible to receive payments from the Fund.

You don’t need to do anything to receive your payment.The Payment Administrator will mail a check to each eligible Class Member.

What is the exclusion deadline?

The exclusion period is 14 days from the date the court approves the settlement.This means that if you do not want to be included in the comparison group, you must submit an exclusion request within 14 days.

How do I file an exclusion request?

What happens if I don’t file an exclusion request?

If you do not submit an exclusion request within the exclusion period, you will be considered a member of the settlement group and will be bound by the terms of the settlement.This means you release Bank of America from all claims related to recall messages.
